Terms of Service

These Terms of Service ("Terms") govern your access to and use of MyOmnihub (the "Service"), operated by MyOmnihub ("we", "our", "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

MyOmnihub is a social media management platform that lets users connect third-party accounts (such as Facebook Pages, Instagram Business profiles, TikTok accounts, and Google Business locations) and publish content to those accounts on behalf of the user. The features and functionality available through the Service may change over time.

2. Eligibility & accounts

You must be at least 18 years old to use the Service. By registering, you confirm that the information you provide is accurate and that you are legally permitted to manage the social media accounts you connect. You are responsible for safeguarding your account credentials and for any activity under your account.

3. Connected third-party accounts

When you connect a third-party social media account, you authorize the Service to publish, schedule, and otherwise interact with that account using the permissions granted via OAuth. You retain ownership of the underlying account and the content you publish through it. You may disconnect any account at any time from the Channels page; doing so revokes the access tokens we hold for that account.

You are responsible for complying with the terms of service of every third-party platform you connect. The Service does not assume liability for actions taken by third-party platforms (including suspensions, content removals, or policy changes affecting the API).

4. User content

You retain all rights to any content (text, images, videos, captions) you upload or publish through the Service. By uploading content, you grant us a limited, worldwide, royalty-free license solely for the purpose of operating the Service — namely, to store the content, transmit it to the third-party platforms you select, and display it back to you in your dashboard.

You represent and warrant that the content you upload does not infringe any copyright, trademark, privacy right, or other rights of third parties, and that you have the right to post it on each platform you target.

5. Acceptable use

You agree not to use the Service to:

  • Publish content that is unlawful, threatening, harassing, defamatory, obscene, fraudulent, or that infringes third-party intellectual property rights;
  • Violate the terms of service or community standards of any connected third-party platform;
  • Send spam or unsolicited bulk messaging;
  • Attempt to access, probe, or test the security of the Service or other users' accounts;
  • Reverse-engineer, decompile, or otherwise attempt to extract source code from the Service;
  • Resell, sublicense, or otherwise exploit the Service for commercial purposes outside the scope of your account;
  • Use the Service to impersonate any person or entity or misrepresent your affiliation.

We reserve the right to suspend or terminate accounts that violate this section, with or without notice.

6. AI-generated content

The Service offers AI-assisted content tools (text generation, image generation). You are solely responsible for reviewing and approving any AI-generated output before publishing it. We make no warranty about the accuracy, originality, or appropriateness of AI output. You agree not to publish AI-generated content that violates section 5 or any third-party platform's policies on AI/synthetic media disclosure.

7. Fees

Some features may require a paid subscription. Fees, billing cycles, and refund policies are disclosed at the time of purchase. We may change pricing with at least 30 days' notice; price changes do not apply retroactively to a billing period already paid.

8. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your account for material breach of these Terms or to comply with legal obligations. Upon termination, your right to use the Service ceases. We will retain account data for up to 90 days after termination, after which it is deleted (except where retention is required by law).

9. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free from third-party platform downtime.

10. Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or related to your use of the Service. Our aggregate liability under these Terms will not exceed the amount you paid us during the 12 months preceding the event giving rise to the claim, or USD $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) content you publish through the Service, or (c) your breach of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. Material changes will be communicated via the Service or by email. Your continued use of the Service after the effective date of an update constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which MyOmnihub is incorporated, without regard to its conflict-of-laws principles. Disputes will be resolved exclusively in the courts of that jurisdiction.
